Plaintiffs say Kroger reported "usual and customary" prescription prices that left out its own Savings Club prices, so customers who paid with insurance paid more than they should have; Kroger denies any wrongdoing, and its notice states that the court has not decided which side is right. Nothing in this settlement is paid automatically: a class member who wants money files a claim form, and one who wants out must say so in writing earlier.

What a claimant can receive
A $17,000,000 fund paid by Kroger. Court-approved attorneys' fees (up to one third), costs (up to $610,325.71), service awards (up to $5,000 each), and notice and administration costs come out; the Net Settlement Fund is shared pro rata by each valid claimant's Recognized Claim, based on what the claimant paid. No per-person amount is stated. The notice says the initial distribution will be allocated to class members within 120 days after the Effective Date (when the judgment is final and no longer appealable); no date announced.

Yes, in part. The claim form is an attestation of an out-of-pocket amount in a band. Claims of $8,000 or more must include documents. Claimants under $8,000 whom the administrator finds are not on Kroger's list of known purchasers will be asked for documents; the administrator may ask for more proof.

Who is in the class

The class is everyone in the United States and its territories who paid, in whole or in part, for one or more prescription drugs from Kroger using insurance, from December 9, 2018 through August 23, 2026 U.S. District Court, S.D. Ohiochecked October 1, 2026. "Kroger" here includes pharmacies that Kroger or its affiliates own or operate. The list of those stores is an exhibit to the plan of allocation on the official website; this page does not reproduce it.

The notice leaves out judges and their staff, Kroger's officers, directors and affiliates, and anyone who already sued, arbitrated or settled with Kroger over Savings Club pricing. This case is about what insured customers paid at the pharmacy counter. It is not a data breach case, and it is separate from other cases that name Kroger.

What the notice carries

The long-form notice opens with two standard lines: a federal court authorized it, and it is not a solicitation from a lawyer. It also asks readers not to telephone the court or the clerk. Questions go to the administrator instead, at (888) 535-4262 or info@krogersavingsclubsettlement.com.

People Kroger already identified as buyers receive a notice with an identification number, and the claim form has a box for a "Notice Identification Number (if provided by Settlement Administrator)". A person who never got a notice can still file. The notice does not say whether notices go out by mail, email or text, so this page does not say either.

The court order appoints Angeion Group as the settlement administrator; the notice prints its Philadelphia address, 1650 Arch Street, Suite 2210, Philadelphia, PA 19103, without the company name. The exclusion and objection deadline falls well before the claim deadline, so by the time the claim deadline arrives, the other two choices have closed. Excluding yourself and claiming cannot be combined: an exclusion keeps your right to bring your own case about this and gives up any payment. On doing nothing, the notice says a class member who files no valid claim gets no payment, and that "even if you do not file a valid claim, unless you exclude yourself from the Settlement Class, you will nevertheless be bound" by the court's rulings and the settlement's releases. What a claimant can receive, and the proof rules

Kroger pays $17,000,000 U.S. District Court, S.D. Ohiochecked October 1, 2026 into a settlement fund. Out of that fund the court may first approve attorneys' fees of not more than one third of the Settlement Fund, costs of up to $610,325.71, service awards of up to $5,000 for each named plaintiff, and the cost of notice and administration. What remains, the net settlement fund, is divided pro rata, in proportion to each valid claimant's "Recognized Claim", which is based on what the claimant paid. No official document gives an amount per person, and this page does not estimate one.

The claim form does not ask for receipts by default. You state your estimated out-of-pocket total by choosing a band, and you attest that it is true. The proof rule then depends on that total:

What happens after the deadlines

The court's amended order sets the steps in between: class counsel's fee request is due October 8, 2026, and the brief for final approval and the answers to any objections are due December 28, 2026, before the hearing on January 11, 2027.

If the judge approves the settlement, the notice says the initial distribution of the net fund will be allocated to class members “within 120 days after the Effective Date” U.S. District Court, S.D. The settlement agreement defines the Effective Date as the date the judgment becomes final and can no longer be appealed, and the notice warns that an appeal could take several years.
